Australian Study Requirement (ASR), Regional & PY Bonus Points, Overseas Non-Traditional Degrees (CEP), and RPL Qualification Risks
Reg 1.15F dual 92-week CRICOS and 16-month onshore clocks, credit exemptions, regional/STEM/PY points, Korean Credit Bank and Associate Degrees under CEP, and ASQA RPL cancellations
- If I receive one semester (23 weeks) of credit exemption from my overseas university toward a 92-week Australian Master's degree, do I lose eligibility for Subclass 485 and the 5-point Australian Study bonus?
- Can a Korean Credit Bank System degree, cyber university bachelor's degree, or 2-to-3-year Associate Degree qualify for 15 bachelor's points in General Skilled Migration?
- Does an Australian Recognition of Prior Learning (RPL) certificate count toward the Australian Study Requirement for Subclass 485, and what are the visa risks of ASQA qualification cancellations?
In points-tested General Skilled Migration (Subclasses 189, 190, and 491) and Temporary Graduate (Subclass 485) applications, qualification and study points turn strictly on CRICOS registered weeks (minimum 92 weeks), physical onshore study (minimum 16 calendar months), Department of Education Country Education Profiles (CEP), and verified competency assessment rather than holding a certificate alone. Overseas credit exemptions deduct directly from countable CRICOS weeks under reg 1.15F, non-traditional overseas credentials such as Associate Degrees or Credit Bank degrees require CEP and skills-assessing authority verification before claiming 15 points on SkillSelect, and Recognition of Prior Learning (RPL) awards contribute zero CRICOS weeks while carrying severe ASQA cancellation exposure if issued without genuine practical assessment.
Park & Co Lawyers · General Legal Consultation Guide Consultation Guide
In Australian points-tested General Skilled Migration (Subclasses 189, 190, and 491) and Temporary Graduate visa (Subclass 485) applications, educational and study bonus points are not awarded merely because an applicant holds a graduation certificate; they are strictly determined by CRICOS registered course duration (92 weeks), physical onshore study duration (16 calendar months), the Department of Education's Country Education Profiles (CEP), and lawful competency assessment. This guide sets out general Australian immigration law information current as at 3 November 2026 and does not guarantee any specific visa or points assessment outcome.
1. The Dual Clock (92 Weeks & 16 Calendar Months) and Credit Exemptions Under the Australian Study Requirement (ASR, reg 1.15F)
Assessed by the Department of Home Affairs under reg 1.15F of the Migration Regulations 1994 (Cth), the Australian Study Requirement (ASR) serves as the foundational gateway for both the 5-point skilled migration study bonus (Schedule 6D Item 6D81) and the Temporary Graduate visa (Subclass 485, carrying a primary applicant Visa Application Charge of AUD $5,750 as at November 2026). All five requirements below must be satisfied concurrently:
- Completion of a CRICOS-Registered Qualification: You must complete a Bachelor's or higher degree, Diploma, or Trade Qualification formally registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS) and delivered in English while holding a visa permitting study.
- Minimum 92 Registered CRICOS Weeks: Under
LIN 19/085,2 academic yearsmeans at least 92 standard registered CRICOS weeks. Taking longer in real time due to failing and repeating subjects never increases countable weeks beyond the course's registered CRICOS duration. - Minimum 16 Calendar Months of Physical Study in Australia: Measured from the actual first day of classes (excluding orientation) through to the date academic completion is formally notified, physical face-to-face study in Australia must span at least 16 calendar months.
- Deduction of Overseas Credit Exemptions and Onshore Student Visa Restrictions: Receiving credit transfer or exemption based on overseas university units or non-CRICOS study reduces your countable weeks accordingly. For instance, receiving 23 weeks of credit toward a 92-week Master's program leaves only 69 countable weeks and fails the ASR. Moreover, following the 2 October 2026 regulatory amendments restricting onshore Student visa re-applications into lower-AQF or packaged courses simply to make up missing study weeks, applicants must verify before enrolment whether non-overlapping previously completed Australian CRICOS qualifications can lawfully be aggregated.
- Strict 6-Month Completion Deadline and Age 35 Cap for Subclass 485: Under
reg 1.15F(2), the statutory completion date is the date the education provider notifies you in writing that academic course requirements have been met, not the graduation conferral ceremony. Under current Subclass 485 settings (capped at age 35 generally, with an age 50 exception for Master's by Research and PhD graduates, and with the former 2-year selected-degree extension and COVID replacement stream abolished), the visa application must be lodged within 6 months of the completion date; by contrast, the 5-point skilled migration study bonus has no post-completion expiry period.
2. Regional Study (5 Points), Specialist STEM Research (10 Points), and Professional Year (5 Points)
Under the General Skilled Migration points table (Schedule 6D, statutory minimum pool mark 65 points; primary Visa Application Charge AUD $6,140), claiming additional study-related bonus points requires strict compliance with each item's statutory criteria:
- Study in Designated Regional Australia (
Item 6D101, 5 points): You must satisfy the 2-year Australian Study Requirement via on-campus attendance at a campus located in a Designated Regional Area (Category 2 or Category 3 postcodes, excluding Sydney, Melbourne, and Brisbane) while physically residing in that regional area throughout your study. Semesters completed via distance education or offshore online study do not qualify for regional study points. - Specialist Education Qualification (
Item 6D7A1, 10 points): Awarded strictly where an applicant completes an Australian Master's degree by research or Doctoral degree (PhD) comprising at least 2 academic years (92 CRICOS weeks) in a designated STEM or ICT field (natural and physical sciences, information technology, or engineering and related technologies). Master's by coursework degrees are excluded. - Professional Year in Australia (
Item 6D61, 5 points): You must complete an approved Professional Year program of at least 12 months in Accounting (CPA Australia, CAANZ, or IPA), ICT (ACS), or Engineering (Engineers Australia) within the 48 months immediately preceding your SkillSelect invitation date (measured by the completion certificate issue date).
3. Qualification Points for Korean Non-Traditional Credentials (Credit Bank, Self-Study, Open/Cyber Universities & Associate Degrees)
Qualification points under Schedule 6D (6D.7) are not cumulative; only your single highest recognised qualification is scored (Doctorate 20 points; Australian Bachelor's degree or comparable overseas Bachelor's degree 15 points; Australian Diploma, Australian Trade Qualification, or qualification recognised by the relevant skills assessing authority 10 points). Under reg 2.26AC(5), overseas non-traditional degrees are not left to ad hoc officer discretion: they are assessed against the Department of Education's Country Education Profiles (CEP) and the equivalency standards of the relevant skills assessing authority:
- 2-Year and 3-Year Associate Degrees: Under CEP guidelines, Korean 2-year and 3-year Associate Degrees align with the AQF Diploma or Advanced Diploma tier rather than an AQF Level 7 Bachelor's degree, meaning 15 Bachelor's points cannot be claimed. Applicants may claim 10 points (
Item 6D75) only where the relevant skills assessing authority explicitly accepts that Associate Degree as satisfying the occupational qualification standard. - Academic Credit Bank System (ACBS), Bachelor's Examination for Self-Education (BDES), Open University, and Cyber University Bachelor's Degrees: Equivalency outcomes vary according to institutional accreditation tier, credit composition (the proportion of formal university coursework units versus licence-substituted or exam-substituted credits), and major depth. Claiming 15 points on a SkillSelect EOI without prior verification risks reduction to 10 or 0 points at visa assessment, resulting in mandatory refusal for falling short of the invited score. Securing formal VETASSESS Points Test Advice (or equivalent assessing authority verification) before claiming 15 points is the safest course.
- Employer Sponsored Visa (Subclass 482 SID) Qualification Alignment: Short-track Credit Bank or online hospitality and trade qualifications may not automatically substitute for Australian Certificate III or Certificate IV trade qualifications if supervised practical training hours and competency units do not align.
4. Legal Limits of Recognition of Prior Learning (RPL) Qualifications and ASQA Cancellation Risks
While an RPL qualification (Certificate III, Certificate IV, or Diploma) issued by a Registered Training Organisation (RTO) following genuine verification of practical skills and industry experience is a recognised award under the Australian Qualifications Framework (AQF), three critical legal limitations and compliance risks apply in migration practice:
- Zero Countable ASR Weeks and Ineligibility for Subclass 485: Because RPL assesses prior experience rather than delivering a CRICOS-registered course, countable study duration under
reg 1.15Fis 0 weeks. An RPL certificate alone cannot satisfy the Australian Study Requirement for Subclass 485 or support claims for the 5-point Australian study or 5-point regional study bonuses. - Dual Verification of Underlying Employment Evidence: Skills assessing authorities (such as TRA and VETASSESS) and Home Affairs do not rely on the RPL certificate copy alone; they independently cross-check underlying payslips, ATO tax records, superannuation contributions, and workplace photo/video evidence. Furthermore, in assessment tracks that count only post-qualification employment, work performed prior to the RPL issue date may be excluded.
- ASQA Mass Qualification Cancellations (
NVR Act s 56): The Australian Skills Quality Authority (ASQA) has conducted large-scale statutory cancellations under section 56 of the National Vocational Education and Training Regulator Act 2011 (Cth) targeting non-compliant RPL awards issued purely on paper without practical competency testing. Failing to substantiate competency within the typical 7-to-14-day show-cause window invalidates the qualification, collapsing associated skills assessments and creating severe visa refusal or cancellation exposure.
5. Pre-Consultation Document Audit Checklist
- Original CRICOS Course Codes, registered weeks, Confirmations of Enrolment (CoEs), final academic transcripts, and formal Completion Letters for every course completed in Australia
- Transcript check for any overseas credit transfers or RPL exemptions, recalculating net onshore face-to-face CRICOS weeks (minimum 92 weeks) and calendar months (minimum 16 months)
- Complete regional residence evidence across the entire study period (tenancy agreements, utility bills, bank statements showing local day-to-day spending) and confirmation of zero distance/online semesters if claiming 5 regional study points
- Professional Year Record of Completion confirming the completion date falls within 48 months prior to the expected SkillSelect invitation date
- Official English degree certificates, detailed academic transcripts (itemising credit sources for Credit Bank, self-study, cyber university, or Associate Degree holders), and any existing skills assessment outcomes
- If holding an Australian RPL certificate: current registration status of the issuing RTO, official USI transcript extract, practical competency assessment records, and complete underlying tax/payroll evidence
- Prior confirmation that Park & Co Lawyers strictly does not broker or arrange RPL issuance, providing independent legal compliance review of existing qualifications and General Skilled Migration strategy (GSM Case Review) only

In-Depth Practical Commentary & Case Analysis
When preparing for Australian points-tested General Skilled Migration or a Temporary Graduate visa (Subclass 485), working out exactly how many points your degree attracts and how the 2-year study rule is measured can quickly become confusing. Online forums often claim that Korean Credit Bank or cyber university degrees come down to the luck of which case officer opens your file, or repeat dangerous stories suggesting that a Recognition of Prior Learning (RPL) certificate solves study requirements overnight. Before locking points into a SkillSelect Expression of Interest (EOI), it is entirely natural to wonder whether your claimed score will actually survive formal scrutiny.
In practice, qualification and study points are never decided by luck or informal sympathy; they turn on strict statutory numbers and official equivalency tables. If 5 points are deducted after you receive an invitation and pay the primary Visa Application Charge (as at November 2026: AUD $6,140 for GSM subclasses and AUD $5,750 for Subclass 485), your application faces mandatory refusal for falling below the invited score, with government charges generally non-refundable. Below are the four rules that most frequently trip up applicants.
The Dual ASR Clock: 92 CRICOS Weeks, 16 Calendar Months, and Credit Exemptions
The Department of Home Affairs Australian Study Requirement (reg 1.15F) underpins both Subclass 485 eligibility and the 5-point GSM study bonus. You must complete CRICOS-registered study in English in Australia while simultaneously meeting at least 92 registered CRICOS weeks (2 academic years) and at least 16 calendar months of physical study onshore. Credit exemptions are the number-one trap here: taking one semester (23 weeks) of credit from an overseas university toward a 92-week Master's degree cuts your countable Australian study down to 69 weeks, breaking the 2-year requirement. Conversely, repeating failed units only lengthens your stay without adding a single week beyond the course's registered CRICOS duration.
Following the 2 October 2026 regulatory tightening, onshore applicants can no longer easily lodge another Student visa in a lower-level or packaged course inside Australia just to top up missing weeks. However, combining an earlier completed Australian CRICOS qualification with a new non-overlapping CRICOS course to reach 92 weeks and 16 months remains a viable structure. Keep the timing distinction clear as well: Subclass 485 (capped at age 35 generally, age 50 for Masters by Research and PhD graduates, with the former 2-year selected-degree extension abolished) must be lodged within exactly 6 months of your academic Completion Letter date (not graduation day), whereas the 5-point GSM study bonus carries no 6-month expiry.
Regional Study, Specialist STEM Research, and Professional Year Bonus Points
Bonus study points carry equally tight fine print. Claiming 5 regional study points requires attending on-campus classes and physically living in a Designated Regional Area outside Sydney, Melbourne, and Brisbane; distance education or pandemic-era offshore online semesters disqualify that period. The 10-point Specialist Education bonus applies strictly to Australian Master's by Research or Doctoral (PhD) degrees of at least 2 academic years in designated STEM and ICT fields, excluding coursework Master's degrees. Likewise, the 5-point Professional Year bonus in Accounting, ICT, or Engineering counts only if your completion certificate was issued within the 48 months immediately before your SkillSelect invitation.
Non-Traditional Overseas Degrees Under Country Education Profiles (CEP)
What about Korean Credit Bank System degrees, self-study bachelor's exams, Korea National Open University, cyber universities, or Associate Degrees? Skilled migration scores only your single highest qualification rather than adding multiple degrees together. To claim 15 Bachelor's points for an overseas award, it must satisfy Australian Bachelor's equivalency (AQF Level 7) under the Department of Education's Country Education Profiles (CEP) and the relevant skills assessing authority's standards. Two-year and three-year Korean Associate Degrees are generally benchmarked at AQF Diploma level, barring a 15-point claim and qualifying for 10 points only where explicitly endorsed by your assessing authority in a positive skills assessment. Because Credit Bank and cyber university bachelor's degrees vary depending on institutional accreditation and formal coursework ratios, verifying equivalency beforehand (for example, through VETASSESS Points Test Advice) before claiming 15 points on an EOI is far safer. Similarly, for Subclass 482 SID sponsored visas, a short-track Credit Bank hospitality degree rarely substitutes automatically for hands-on Australian Certificate III or IV trade training.
RPL Qualifications: Zero CRICOS Weeks and ASQA Cancellation Risks
Finally, trade applicants frequently ask about Recognition of Prior Learning (RPL) certificates. Where a Registered Training Organisation (RTO) genuinely assesses real work history and practical skills, the resulting RPL award is a valid AQF qualification. Recently, however, the Australian Skills Quality Authority (ASQA) has cancelled thousands of substandard RPL certificates issued purely on paper without practical assessment. Missing a short show-cause window (often around 14 days) and having an RPL certificate cancelled can invalidate a skills assessment and trigger Public Interest Criterion 4020 (bogus or misleading document) exposure. Above all, because RPL involves zero CRICOS classroom delivery, it contributes 0 weeks toward the Australian Study Requirement and cannot be used to lodge Subclass 485 or claim 5 Australian study points.
Park & Co Lawyers strictly does not broker or arrange RPL certificates. Instead, our solicitors independently audit the legal validity of your Australian and overseas qualifications, CRICOS week calculations, and General Skilled Migration points strategy (GSM Case Review).
